Mag[Py] needs to make sure our customers use their Mag[Py] superpowers for good, not evil.
This policy describes prohibited uses of the Mag[Py] Services and Mag[Py] Website. Capitalized terms used but not otherwise defined here are defined in the Mag[Py] Terms of Service.
By using the Services or the Website, you agree to the latest version of this policy. If you violate this policy or authorize or help others to do so, we may suspend or terminate your use of the Services.
The examples described in this policy are not exhaustive. We may modify this policy at any time by posting a revised version on the Mag[Py] Website.

No Illegal, Harmful, or Offensive Use or Content
You may not use, or encourage, promote, facilitate or instruct others to use, the Services or Mag[Py] Website for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive.

You agree not to use the Services for High Risk Activities, as defined in the Mag[Py] Terms of Service.
No Arms Dealing
You agree not to use the Services to process or store any data that is subject to the International Traffic in Arms Regulations or the Export Administration Regulations maintained by the United States Department of State. US law follows the goods so to speak, and therefore a company does not need to be located in the USA to be subject to US export controls. The US Government claims worldwide application of US export control laws (extraterritoriality) and seeks to penalise those who breach them, regardless of location.
No Security Violations
You may not use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”).

No E-Mail or Other Message Abuse
may not use the Services in any way in order to distribute, publish, send, or
facilitate the sending of unsolicited mass e-mail or other messages,
promotions, advertising, or solicitations (like “spam”), including commercial
advertising and informational announcements. You will not alter or obscure mail
headers or assume a sender’s identity without the sender’s explicit permission.
You will not collect replies to messages sent from another Internet service
provider if those messages violate this policy or the acceptable use policy of

Usage ceilings are set according to the level of your account plan. If exceeded, you will be subject to additional spot pricing. We monitor your usage levels closely and will attempt to contact you if we see unusually high activity on your account. You agree not to take any action (directly or indirectly) that imposes or may impose (as determined by Mag[Py] in our sole discretion) an unreasonable or disproportionately large load on Mag[Py]’s or its third party providers’ infrastructure.

If you become aware of any violation of this policy, you will immediately notify us and provide us with assistance, as requested, to stop or remedy the violation.

This policy outlines how Mag[Py] determines fees and charges, and performs billing.
Mag[Py] prices and invoice amounts are denominated in European Union Euros.
At the end of each billing period, if you used more resources than were included in your account plan, simply pay for what you used. Contact us directly for spot prices or visit https://www.magpy.com/pricing
During the Evaluation Period, there will be no fees applied until the point in which your account is upgraded. During this period you may be subject to a usage caps.
We invoice once per month, unless we determine your invoice is at risk of non-payment, in which case we may invoice more frequently or require that you pay in advance.
All invoices are due upon receipt unless otherwise indicated.
Late payments may bear interest at the rate of 8.0% plus European Central Bank rate per month (or the highest rate permitted by law, if less) determined and compounded daily from the date due until the date paid. You will reimburse any costs or expenses (including, but not limited to, reasonable attorneys’ fees) incurred by Mag[Py] to collect any amount that is not paid when due. Amounts due from you under may not be withheld or offset by you against amounts due to you for any reason.

(“taxes”), pursuant to the Mag[Py] Terms of Service. You will pay any
additional amounts as are necessary to ensure that the net amounts received by
Mag[Py] after all such taxes are paid are equal to the amounts that Mag[Py]
would have been entitled to if such taxes did not exist.
Changes to this Policy
Fees and charges for any new Service or new feature of a Service will be effective when we post updated fees and charges on www.magpy.io, unless we expressly state otherwise in a notice. We may change spot pricing by giving you at least 30 days’ advance notice before the beginning of the billing cycle in which such change will take effect.

We collect the following information:
Content: We collect and store content that you create, input, submit, post, upload, transmit, or store in the process of using our Services, including information from end users of any application that you develop using our Services and/or that we host on your behalf. Such content may include any personal or other sensitive information submitted using our Services.
Other submissions: We collect other data that you may submit to our Services or us directly, such as when you request customer support or communicate with us via email or social media sites.

Web Logs and Analytics Information: We record certain information and store it in log files when you interact with our Services. This information may include Internet protocol (IP) or other device addresses or ID numbers as well as browser type, Internet service provider, URLs of referring/exit pages, operating system, date/time stamp, information you search for, locale and language preferences, your mobile carrier, and system configuration information. We and our analytics providers also collect and store analytics information when you use our Services to help us improve our Services.

designated as confidential by you, shall not create any obligation of
confidentiality for Mag[Py], unless we expressly agree so in writing.

Even after you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us regarding the Services.
HIPAA and PHI in Relation to Mag[Py] Services
You understand and acknowledge that Mag[Py] or any of its Containerised Services or systems are NOT configured to receive and store personal health information (“PHI”), as that term is defined under the Health Insurance Portability and Accountability Act (“HIPAA”) and that Mag[Py] is neither a “Covered Entity” nor a “Business Associate,” as those terms are defined in HIPAA. As such, you agree not to use the service or provide access to or submit any PHI to Mag[Py] when requesting technical and/or support services, in either case, to, directly or indirectly, submit, store or include any PHI as part of the data that you share with us. Mag[Py] reserves the right to terminate this Agreement by cancelling your account or any portion of your access to the Services immediately, and without notice, if you are found to be in violation of this Section.
Services are not directed to individuals under 13. We do not knowingly collect
personal information from children under 13. If we become aware that a child
under 13 has provided us with personal information, we will take steps to

The core Mag[Py] Service and APIs are hosted in the European Union. You may choose to run Mag[Py] Services in non-E.U. regions, such as the United States or other regions of the world with laws governing data collection and use that may differ from E.U. law. Please note that when you use the core Mag[Py] Service and APIs, you are transferring your information outside of those regions to the European Union for storage and processing. By providing your information, you consent to any transfer and processing in accordance with this Policy.

Identifying the Data Controller and Processor
Data protection law in certain jurisdictions differentiates between the “controller” and “processor” of information. In general, the Customer is the controller of Customer Data. In general, Mag[Py] is the processor of Customer Data and the controller of Other Information. MAGPY S.R.L, an Italian company based in Milan, Italy, is the controller of Other Information and a processor of Customer Data relating to Authorized Users who use the platform
Individuals located in certain countries, including the European Economic Area, have certain statutory rights in relation to their personal data. Subject to any exemptions provided by law, you may have the right to request access to Information, as well as to seek to update, delete or correct this Information. To the extent that Mag[Py]’s processing of your Personal Data is subject to the General Data Protection Regulation, Mag[Py] relies on its legitimate interests, described above, to process your data. You are responsible for properly configuring and using the Services and taking your own steps to maintain appropriate security, protection and backup of Your Content, which may include the use of encryption technology to protect Your Content from unauthorized access and routinely archiving Your Content. Mag[Py] provides many built-in controls for you and where configurable or optional security controls (such as encryption) are offered as part of the Services, you are responsible for configuring or enabling those controls. You are ultimately responsible for determining whether the security controls applied to your Applications and data are sufficient for your requirements.
Mag[Py] access credentials and private keys
generated by the Services are for your internal use only. You may not sell,
transfer or sublicense them to any other entity or person, except that you may
disclose your private key to your agents and subcontractors performing work on

Publicly disclosing a security vulnerability without informing us first puts the community at risk. Without limiting any provision of the Mag[Py] Terms of Service, we will implement reasonable and appropriate measures designed to help you secure Your Content against accidental or unlawful loss, access or disclosure.
Mag[Py] Internal Security
A - Mag[Py] Access
We do not access or use Your Content for any purpose other than for developing and operating the Services and as required by law.
B - Security Management
Mag[Py] conducts regular security and vulnerability assessments of our systems and applications. Code undergoes automated testing and manual code review prior to being deployed to production. Our security team receives regular notifications of vulnerabilities and patches on a continuous basis.
This policy outlines Mag[Py]’s support practices and resources. It also identifies your support obligations to your customers.

Support Business Hours
Normal Mag[Py] business hours are between 09:00 and 19:00 GMT+1.
We will announce if we intend to discontinue or make backwards incompatible changes to any Service. We will always try to give you as much time as possible to make any necessary modifications to your applications or processes. This policy does not apply to versions, features, and functionality that we label as “beta” or “experimental.”
We may provide documentation for the Services and their use. Our documentation may specify restrictions on how Applications may be built or configured, or how Services must be configured. You agree to comply with any such restrictions as specified throughout your agreement with us.
End User Support
You are responsible for providing customer service (if any) to End Users. We do not provide any support or services to End Users unless we have a separate agreement with you or an End User for the provision of such services.
Mag[Py]’s systems are continuously monitored by automated systems and health checks. In the event of any issue that adversely affects the performance, security, reliability, or integrity of the Services, we will receive notification and respond immediately.
This policy grants you limited permission to use the Mag[Py] Marks in connection with your use of the Services.
These Mag[Py] Trademark Guidelines (the “Trademark Guidelines”) form an integral part of the Mag[Py] Terms of Service (the “Terms of Service”) between MAGPY S.R.L. (“Mag[Py],” “we,”“ ”us,“ or ”our“) and you or the entity you represent (”you“).
Obligations under this policy (both ours and yours) are incorporated by reference into the Mag[Py] Terms of Service.
The Mag[Py] Marks are assets of significant value to us and these Trademark Guidelines are intended to preserve that value. These Trademark Guidelines provide you a limited permission to use the Mag[Py] Marks (as defined below), in connection with your use of the Services (as defined in the Terms of Service), or in connection with software products designed to be used with the Services, on the terms set forth herein and in the Terms of Service, until such time as we may terminate such permission, which we may do at any time, in our sole discretion.
For the purposes of these Trademark Guidelines, “Mag[Py] Marks” means the following trademarks, service marks, service or trade names, logos, product names, or designations of Mag[Py] and its affiliates:

"Mag[Py],” “Mag[Py], S.R.L.,”, “MAGPY” and any other Mag[Py] Marks and Services made available from time to time.
Provided that you are in good standing with a current and valid account for use of the Services and provided, further, that you comply at all times with the terms of both the Terms of Service and these Trademark Guidelines, we grant you a limited, non-exclusive, non-transferable permission, under our intellectual property rights in and to the Mag[Py] Marks, and only to the limited extent of our intellectual property rights in and to the Mag[Py] Marks, to use the Mag[Py] Marks for the following limited purpose, and only for such limited purpose:

Your permission to use the Mag[Py] Marks is a limited permission and you may not use the Mag[Py] Marks for any other purpose. You may not transfer, assign or sublicense your limited permission to use the Mag[Py] Marks to any other person or entity.

Modification and Termination

No Affiliation or Endorsement
You will not display the Mag[Py] Marks in any manner that implies that you are related to, affiliated with, sponsored or endorsed by us, or in a manner that could reasonably be interpreted to suggest that your content, application, web site, product or service, has been authored or edited by us, or represents our views or opinions.
You may only use the Mag[Py] Marks in a manner designed to maintain the highest standard, quality and reputation that is associated with the Mag[Py] Marks and you will not use the Mag[Py] Marks to disparage us or our products or services.
No Dominant Display; Mag[Py] Mark Differentiation
You may not display any Mag[Py] Mark as the largest or most prominent trademark in any materials (including, without limitation, any web site or product literature) associated with your content, application, software tool or other software application. When using any Mag[Py] Mark (other than the Logo, with respect to which the formatting requirements set forth below, or in a URL), you must distinguish the Mag[Py] Mark from the name of your content and/or other surrounding text by capitalizing the first letter of the Mag[Py] Mark, capitalizing or italicizing the entire Mag[Py] Mark, placing the Mag[Py] Mark in quotes, or using a different style or colour of font for the Mag[Py] Mark.
Formatting Requirements with Respect to the Logo
No Modification. We will make the Logo images available to you on the Mag[Py] site. You may not remove, distort or modify any element of the Logo; provided however, you may transform the file format itself, for ease of use.
Colours. The Logo image must be represented in its original pantone colour scheme. The Logo text may be represented in its original dark cobalt blue colour (#273C5A) on a white (#000000) background, or vice versa.
Spacing. The Logo must appear by itself, with reasonable spacing (at least the height of the Logo) between each side of the Logo and other graphic or textual elements.
Size. The Logo, as shown in Section 2 of this Policy, indicates the minimum size at which you may display it to ensure that the type and trademark notations are legible. The minimum size for the Logo shall be: Pixels: 150×50.
Alt/Title Attribute. The Alternative Text (alt/title attribute of the image tag) should either be set to the following text or be left blank: “Powered by Mag[Py]”.
Permissible Uses of the Mag[Py] Marks
Except for the Logo (with respect to which the formatting requirements are set forth above), you may only use the Mag[Py] Marks: (i) in a relational phrase using “for” or one of the limited number of equivalent naming conventions , as set forth below; or (ii) to the right of the top level domain name in a URL in the format set forth below.

Equivalents: You may replace “by” in the example above with any of the following, so long as the term you use is accurate when used with the Mag[Py] Marks you use: “powered by”; “built using”; “developed on”; “developed using.”

Equivalents: You may replace “Mag[Py]” in the example above with any of the Mag[Py] Marks, so long as your usage of the Mag[Py] Marks is accurate.
You shall link each use of the Mag[Py] Marks directly to the following URL, wherever technically feasible: https://www.Magpy.io. You may open the URL in a new browser window. You may not link the Mag[Py] Marks to any web site other than the primary URL for the applicable Service. You may not frame or mirror any of our web site pages.
You may not hyphenate, combine or abbreviate the Mag[Py] Marks. You shall not incorporate the Mag[Py] Marks into the name of your organization, or your services, products, trademark or logos. The foregoing prohibition includes the use of the Mag[Py] Marks in the name of any application, service or product or in a URL to the left of the top-level domain name (e.g., “.com”, “.net”, “.uk”, etc.). For example, URLs such as Magpy.mydomain.com", “Magpyplus.com” are expressly prohibited.
You must include the following statement in any materials that include the Mag[Py] Marks: “Mag[Py], the Mag[Py] logo, [and name any other Mag[Py] Marks used in such materials] are trademarks of Mag[Py], s.r.l. or its affiliates in Italy and/or other countries.” In addition, the Mag[Py] Marks must be designated with the ™/“tm” notice as indicated in Section 2 of this Policy.
No Misleading Use
You may not display the Mag[Py] Marks in any manner that is misleading, unfair, defamatory, infringing, libellous, disparaging, obscene or otherwise objectionable as determined by us in our sole discretion.
You may not imitate the trade dress or “look and feel” of any of our web sites or pages contained in any of our web sites, including without limitation, the branding, colour combinations, fonts, graphic designs, product icons or other elements associated with us.
Compliance with Law; Appropriate Activities
You may not use the Mag[Py] Marks in any manner that violates any Italian or foreign, federal, state, provincial, municipal, local or other, law or regulation. Without limiting the foregoing, or any provision in the Terms of Service, you may not display any Mag[Py] Mark on your site if your site contains or displays adult content or promotes illegal activities, gambling, or the sale of tobacco or alcohol to persons under twenty-one (21) years of age.
Reservation of Rights
Except for the limited permission specified in Section 3 above, nothing in the Terms of Service or this Policy shall grant or be deemed to grant you any right, license, title or interest in or to any Mag[Py] Mark or any of our or our affiliates’ other trademarks, service marks, trade names, logos, product names, service names, legends, other designations, or abbreviations of any of the foregoing. You acknowledge and agree that we and our affiliates retain any and all intellectual property and other proprietary rights in and to the Mag[Py] Marks. All use by you of the Mag[Py] Marks including any goodwill associated therewith, shall inure to the benefit of Mag[Py].
You agree that you will not, at any time, challenge or encourage, assist or otherwise induce third parties to challenge the Mag[Py] Marks (except to the extent such restriction is prohibited by law) or our registration thereof, nor shall you attempt to register any trademarks, service marks, trade names, logos, product names, service names, legends, domain names, other designations, or abbreviations of any of the foregoing, or other distinctive brand features that are confusingly similar in any way (including, but not limited to, sound, appearance and spelling) to the Mag[Py] Marks.
